Pursuant to Article 6 paragraph 4 in conjunction with Article 101 of the Law on Copyright and Related Rights of February 4, 1994, the broadcasting of a phonogram or videogram means its dissemination by radio or television transmission through wireless networks (terrestrial or satellite) or cable networks.
Pursuant to Article 94 paragraph 5 of this Law, in the event of the broadcast of a phonogram or videogram which had already been introduced to the market, the producer is entitled to a proper remuneration.
Radio and television broadcasters are therefore required to conclude relevant agreements with ZPAV, specifying the amount and terms of payment of the remuneration for the broadcast of phonograms and/or music videograms.
